Ebay seller ferndowncameras->Keith Rock's new outfit

I have already called Voytek and I talked to him. We live close to each
other and we both speak Polish.
I trust Voytek in 100%. I am going to give him my lens, and we agreed that
utill Voytek gets his money from ebay, my son will be using Voytek's lens.
I think that the seller rockycamera deserves appropriate feedback and I
will do it for him in a while. I am single mother who is bringing up a 16
years old son. Frankly,I hate such situation when somebody treats me as a
hopeless and defenseless person, just because I am a woman.

Quick question, is the Tammie the same lens that was sold to patrickh as well?

I'm really sorry to hear about your troubles Grace and Voytek. I heard a similar story from someone else yesterday, who bought from a completely different buyer but was also totally lied to and ended up with something in a totally different condition to that described. What a shame it is that these hideous people exist and feel it necessary to scam so many others Sad

In my post above was nothing personal. I do not blame anybody who still buys from rocky. With this seller is clear. He doesn't care about anybody. He only cares about money.
Last year I bought from rocky Tamron 19AH. It was faulty - fungus. I complained, he responded rapidly. He did agree for everything. I returned lens. And this was it. Twice he respond that nothing was delivered to him and than -silence. I had neither lens nor money. He is so cheap that he was selling this lens again. He even didn't change the photo. I wrote to him. He didn't respond. I place the complain about selling stolen item. Ebay returned me some advices but overall nothing.
Grace already left him negative feedback. In response he called her COMPLETE THIEF. My question is: Why?
He is nobody for me. And this is not the end of my story. It will continue.....

Hi everyone.

I raised the matter of a certain individual of a mineral aspect with eBay and their reply was that they cannot (and will not) prevent or remove defamatory comments left about individuals! I pointed out that calling someone a thief or a 'lair' (sic) is a libel and should be actionable. They 'rely' upon the Digital Millennium Copyright Act' (a piece of American law universally despised) which they claim removes from them any liability for what is written on the eBay site. They also claimed that the feedback was not left 'on the woman's site' but on the other party's and is thus not actionable!

I feel it high time that eBay's arrogance towards fair minded people and honest buyers and sellers was challenged. They have even (in a taped conversation) admitted that stolen goods will not be removed from sale unless a member of law enforcement is involved. They also admitted that even if I recognized something stolen from my house was put up for sale (like a family photo of my kids even) they would STILL NOT stop the sale, and it would be up to me to try civil suit against seller and buyer!

So what does eBay actually represent? It seems to favor bullies, it seems not to care about theft, just getting fees from high volume sellers like our friend. I am thinking of mounting a legal challenge through either our State's Attorney General's office or a class action.

Meanwhile I would suggest that every member who has had a bad experience with our 'friend' contact eBay and make their feelings known. There must be a critical number at which they feel they must take some notice one imagines... or maybe not?

I today spoke to John Kroger's Office (He is the State's Attorney General for Oregon, USA) His office agreed that the Digital Millennium Act was unlikely to protect eBay in the way they like to suggest - it would protect an ISP from an action for copyright infringement in the same way that AT&T as a phone company would not be held liable if I 'broadcast' my radio show on the telephone during a call - but eBay HAS control over its own site. They can monitor what is there, and should not allow defamation, especially since One cannot have any comment made about feedback removed by either the writer or the written about!

To fail to take action when someone has posted a defamatory comment IS they think possibly actionable (though as it is not fraud they could not initiate that action) and to sell goods when one has been warned that they are stolen or fraudulently obtained, or where the goods are fake, IS wrong and a criminal act. If one can show reasonable evidence that the goods are not the legal property of the seller then that is a criminal act and to allow their sale after having been told of these facts can make the seller AND eBay liable as an accessory before and after the fact!

Europe has been far more ready to take action that the US - Two French groups succeeded in having eBay fined for allowing fake goods to be sold on their site. eBay's 'defense' that it was not the seller was dismissed as disingenuous, as they were providing the auction facility, and thus it was no different than Christies or Sotherbey's being told an Old Master was a fake or stolen and allowing the sale to proceed...

Sadly the US seems very reluctant to prosecute US companies- witness the endless bullying we suffer at the hands of the record industry... but as the woman said, if we raise a fuss in the press, and try and get local radio and TV involved, then maybe eBay will do something, if not from honor, then out of embarrassment - so I guess it is up to us to make our feelings about eBay (and some of the *** who trade there) known to one and all?

I am complaining to the Better Business Bureau about eBay (as they are members) and I would advise anyone who has been on the end of Rocky's tirades to ask a solicitor to write him a letter threatening to sue for defamation.

I almost live in hope he would defame me as I would have the time and inclination to defend myself!

Doug, I commend you.

However, I don't see Ebay or Paypal changing. They have been sued before for one reason or another, and they've always settled out of court, and continue to do whatever the hell they want. As long as the two entities have a virtual monopoly on online auctions in the US, they don't care; they'll pay out the millions for the class action, and go on about the scumbag business because in the end, that makes them more money than trying to be an honest, good company but shutting out all the filth like Rocky Camera.

With that said, when the time comes for action, I'll be joining arms Smile

I think Hacksawbob had a very bad experience with Rock so I guess the answer is "the same bad way".

I'm in Ireland, right next door to England, and he had no problem treating me like something nasty I once stepped in...

Sadly, I have not won any of the penny items I was bidding for, so that's 6 feedbacks I cannot give!

Have you noticed the number of times he gets multiple purcahses from the same guys - and also buys multiple items from them? What's that about - mutual instant feedback boosting?

I have drawn the attention of eBay (for what that's worth) to this going on.

Maybe we should all bit 100,00 for every item he has for sale, and then claim APRIL FOOL?

HOLYYYYYYYYYY CR*P!!!!!!!! Why, oh why do I only stumble upon this thread now???? I've bought 4 items from ferndowncameras in the past 3 weeks, total value is approx 60 GBP, and none of them have arrived yet! Plus, I just bidded on and won a nice lens for my FX3 from him yesterday, but I have yet to pay for it.

Helpppp, I think I'm gonna get screwed!!!! What should I do???

I am afraid you can't do nothing. If you paid for insurance and pay with paypal you have good chance to get you money back from Paypal or from seller. If it wasn't insured you did throw out your money.

Attila, thanx for the reply. I did pay with paypal, which is linked to my credit card..but I didn't choose to go for insurance though. So far, I haven't received the items, while the item I won recently I still haven't paid for. I told Rocky that there's a problem with my Paypal account, and it's true. I told him to wait for a few days. Just got a reply from him last night, he said...he did reply very quick though. What should I do??? I'm hoping I'll get the 3 items by this week...and should I pay for the newly-won item or shouldn't i? It's a Sigma Mini Wide 28/2.8 lens for my Yashica FX3. I won it for GBP13 only, including shipping.

Firstly, and to allay any fears you may have; this might just work out okay for you - perhaps there's a genuine reason for the delay.

I too learned too late about Keith Rock's questionable business practices and complete lack of ethics. Unfortunately, it didn't work out in my favour. But I'm just one of literally hundreds who have been ripped off, and *Bay continue to do absolutely nothing about him.

Some day, everybody will be aware of this crook, I make it my business to mention his name everywhere nowadays, in the hope that more people don't get done over by him...

Are based outside the UK? If so, remember it will take a week or so for the stuff to arrive. Keith has a bad rep, and many on here will tell you the reasons why, but remember he also has a lot of positive feedback too. I purchased 4 x items, one went back for a refund. Not ideal, but I was lucky I guess.

Hope your stuff comes through OK, keep us updated.
