Is there anything that can be done about ebay users listing an item that is not theres? I recenty sold my 50mm EBC 1.4. This guy has lefted my aution info and made them his own. This isnt even the glass he is selling. Mine was mint, I wonder what his really look like.

Be sure to let him know that this was a members lens...

YOU own the copyright to your text and your picture - if he uses it without your permission that's a (Federal) offense here in the USA.. write him, write to eBay and mention he legal issue to eBay and that you are the copyright owner and he / she is infringing your rights. They usually respond if you are the owner of the copyright

You can also report them for copying your listing.. either way.. go to the link at the bottom of the listing and complain as often as you can..

I am So So very sorry I was trying to cut/paste the description only.... you know where ebay has the feature of putting brand, what it fits, the MM, wheather it's new/used just to save time didn't realize it copied the WHOLE page! People steal photos and descriptions all the time on eBay. It happens thousands of times a day.

It's annoying, but there's really nothing you can do about it. eBay refuses to take any action, usually.

In the long run, it's no big deal. It's his problem, not your problem. It will soon be forgotten, and it's not like he caused you any monetary damages, so just forget it.

Consider it a compliment that he thought your auction was so great.

(The whole "Federal Offense" idea about a silly little eBay auction is ridiculous)

No Federal agency in existence is going to take any action against a copied eBay auction.

At any rate, to have a case, you have to prove damages.

Many very inexperienced people on internet forums have highly fanciful ideas about laws and enforcements.

I don't see anybody here suggesting the OP make this a legal issue. I think the idea was to use the law as a leverage to get Ebay to take action, not on legal grounds, but more on corporate ethics grounds.

It is true that Ebay, being the dick corporation they are, seldom take action in such cases. However a "they're not gonna do anything about it, why bother?" attitude won't do anything to change the situation for the better, and in fact all but insures that they're gonna get worse.

And you are certain of this how?

The Federal Trade Commission has ordered auctions taken down where copyright is involved, as have the law enforcement agencies of a number of countries.. and what I suggested was that copying an auction is an offence and eBay has a duty to take down any auction where copyright is infringed, once the copyright holder has made them aware of the breach. When they failed to so do in Europe it proved a very costly mistake for them...

I am quite sure if no-one makes a fuss then they won't, and the last thing we need is to give eBay grounds for inaction by having them assert 'no complaints received'?

Spiralcity, his auction still links to the images directly from your Photobucket. You still have some control. Rename or remove the images and he's got nothing. If you're feeling vindictive enough, put a new image of your choosing in the previous one's place (Rename the existing image, then upload a new one with the same name).

His auction is a lie ! He's not selling the MINT lens I posted, thats the problem I see with him using my auction.

I dont want nor did I suggest anything legal. I was hoping a few people would drop him a note and ask to see the lens he's actually selling. Shocked

A friend of mine, who is particular about the quality of photographs he uses, once put an iPod up for auction. Some time later, he found that a German seller had pinched his photographs for his own auctions, and moreover, made the mistake of linking directly to them, so that Ben's web space was being hit by fairly high traffic levels.

Ben got his girlfriend Birgitta, who's German, to prepare a new text to overlay the photographs, and replaced the originals. I can't remember the German text she devised, but it read in English something like 'All the items I sell are non-functioning dummies and do not work. If you ask for your money back, I'll tell you to *%&^% off.' (It was 'kiss my arse' but Ben's English version was more earthy still.)

It worked a treat.

Want ebay to remove his listing? Easy!

Just replace that photo with one of a little tiny dick (with the words "self portrait" imposed on it!) If he doesn't then change the listing, the ebay nudity police will Wink

I don't see what the big deal this is about. I take description and picture (generic ones) from other auctions from time to time. I don't think you can tell the difference between a mint lens and a new lens from pictures anyways, the seller is just lazy to take one of his own. If there is a problem with the lens, the buyer probably will do a chargeback and put the seller in jeopardy. There's no gain in doing so. And you surely will not be put in disadvantage of any kind also.

I just sent him a message via eBay asking to be assured it's the one in the pic, that it's really good, and for a pic of the rear mount. Be interesting to see what he says. Bidding's up to around $11 right now ...

The big deal is, It's not the lens he's selling! My photo's were MACRO shots, and yes, you could see the detail very close. It was easy to see that the lens was mint.

A bit of false advertising when you claim someone elses items as the item your selling, dont you think?

Are you claiming that you claim other peoples items as your own?
If so, please tell me your seller ID so I know never to bid with you.

I removed my photos from photobucket so now he needs to add new pics of the item he's selling. This is the fair way to deal with customers. They may be able to see the actual item they are bidding on. Smile

The implication here is that you are misrepresenting goods as being your own - that's what the big deal is about...

As Spiralcity has already asked, I too would like your eBay username so I make sure never to bid on any of your auctions.

I removed the images. Now he has empty photobucket logos in their place. Very Happy

Generic ones, fine - one packet of cornflakes is the same as any other. This is different though and I'd be pissed off if I bought this and found it wasn't the same one he'd shown.
