You never have anything good to say and you're right, you are like a broke record, a highly negative annoying record.

No, I doubt that I would have permission...please let me know if it needs to be removed....if it causes problems for Attila or this website. It says with compliments and I see no copyright sign on it.
You are right they have some charts on their webpage and they are PDFs so I take it they are free to download...links below

Martin, you don't need permission to reproduce this chart, it's not copyrighted as far as I can see. I'm sure Ilford would be more than happy to see their products being advertised in this way. _________________ "I've got a Nikon camera, I like to take a photograph" - Paul Simon |

+1
I linked to the Ilford site in my sticky about developing, it's free for anyone to download.
http://www.ilfordphoto.com/Webfiles/2006210204272065.pdf
The one Mo has was produced in Australia. I don't know if the developers there have different names, but the chart in my link has several developers not mentioned on Mo's - for instance DD-X and the two types of Ilfotec. _________________ Peter - Moderator |

Unfortunately, that is incorrect. Copyright should be assumed unless it specifically says that it's free to distribute. That fact that it is posted on their website means nothing. I work with copyright most of the time with my job (in a library) so I think I know what I'm talking about. We reproduce other organisations work, but always with their consent.
See para 4 here: http://www.copyrightservice.co.uk/copyright/p01_uk_copyright_law
Linking is fine, but reproducing without permission may not be
Now, as this chart is made public, it is unlikely that Ilford are bothered about it and they would probably (as you say) be pleased of the advertising, but for the sake of an email and piece of mind....
Now, pardon me for trying to protect the forum and its members. _________________ Casual attendance these days

Out of interest Martin, if Mo has bought and paid for that chart, doesn't the right to publish it pass to her? Where does it say you have to keep it secret? It might be a breach if any of us were to download and use it, though.
Maybe the fact that it's 12½ years out of date might make a difference too. _________________ Peter - Moderator |

No, Moira buying the chart doesn't include a right to reproduce it. If we download it this would also be a breach (and we all have downloaded it by viewing it.
Copyright lasts quite a bit longer than 12 years.
Like I said, I'm probably being over cautious, but this is my day-job mentality kicking in. A lot of companies from whom we reproduce information seem surprised that we ask for permission on a publicly available document, but there is a lot of confusion & urban myth over copyright. Plus it is a very difficult area as a lot has yet to be tested in a court of law. _________________ Casual attendance these days |

Dear Moira,
The chart appears to be something that was produced some time back by ILFORD Australia Pty Ltd that no longer exists.
They were part of the ILFORD Imaging company that went into receivership in 2004.
HARMAN technology Limited are now the owners and manufacturers of the ILFORD Brands of black and white photographic materials.
While we cannot verify the accuracy of the content of the Dev Chart we have no objection to you showing it on your Forum.
Likewise we have no objection to you showing a link to the Charts on the ilfordphoto.com website.
Regards,

on a side note I asked on behalf of all film users for them to keep producing film... this is the reply...

Well done, Mo!
I think you deserve a standing slow-clap ending in full blown ovations for that one!
Copyright laws are pretty fundamental in our lives as photographers as we are directly related to it. We should at least try and be aware and follow them to our largest extent.
If you bought a book, are you allowed to xerox all the pages and release your own book?. If I post an image on this forum does that mean since you watched it you can distribute it to magazines?
In this case the chart was 12 years old that held no financial value and was distributed freely at the time, belonging to a company that doesn't exist anymore. So the odds of them suing your ass is rather slim.
Ilfords answer was very nice, kudos to them. And continue shooting film we will! _________________

I think in this circumstance the copyright would be retained by the parent company, but if not, the document would still be covered by copyright for 75 years after the publication of the document. But yes, if they don't exist, how can they sue. Anyway we have our permission to reproduce now.
