My 3 cents.
I am not sure that is legal to charge VAT from ebay buyers. In two cases - YES. If seller bought merchandise from official vendor, wholesale company or for any source where was charged VAT. He was charged and he is charging the final buyer. After, he "by law" has to send balance between paid VAT an charged VAT to the Polish IRS. If this is like "garage sale" there is nothing like duty to pay tax (VAT) for buyer. Also in US if you are in retail business you have to charge tax but only in state. This is a private auction not retail sale. This not a store with fixed price. He is not registered as an ebay Store owner. He is probably registered as a private seller.
Look at the auction # 160264333558. Seller is shipping converter worldwide. There is nothing in the description about tax/VAT. Ask this seller about a "VAT" rules. Does he sell everywhere illegally? I don't think so. This is my private opinion and maybe I am not right. But it is not bad to ask both sellers a question and compare answers. You can also send question to the Polish ebay about a export or import duties - if this kind of transaction between 2 private person means "export". If the seller try to "hook" you up - it is illegal and you can report him to ebay. As a next ebay scammer.

I don't think it's actually illegal, but you're right that he's breaking Ebay Rules. I guess he's a genuine VAT-registered trader and quite properly he must charge VAT on everything he sells, but he's doing it the wrong way round. He should include the VAT in the item price and then offer a discount to buyers outside EU.

If it is not enough visible in my previous post - I apologize. If you say to somebody to pay VAT you have to send part of this charge to certain financial institution along with proper information about this charge. If somebody is selling you second-hand item even it is rare photo equipment and "VAT" it is his additional pocket money it not illegal - this is felony. How about it if he makes false public statement to prove that he is doing something legal. To take advantage over confused buyers and make more money?
As I wrote. It is my guess that he is a cheater. But this is not my problem. If I sell something I post all information the buyer needs to know. This is not a solution to make the description in auction very limited. To make buyer "stupid" giving him "no" information.

If he's a VAT registered trader, there's nothing wrong in what he's doing. Easy enough to find out as he is required to supply his VAT registration number on request. He's been around on ebay long enough for somebody to dob him in if he's conning anybody.
The various VAT authorities in EU countries take very seriously traders charging VAT if they're not entitled to - serious penalties can result, so I doubt he's a fraud and ebay would be an awfully public (and stupid) way of doing it.

Since he registered in eBay Poland, his own country, prices should be VAT inclusive like the ones in every shop around in UE. He basically sells from an electronic shop (expecially with "buy now" items).

If buyers are extra-UE every country has specific procedures to make them not to pay VAT.

All in all it smells, and not good nor nice.
